The Department of Justice (DoJ) has upheld its earlier resolution dismissing a criminal complaint filed against actor Richard Gutierrez. Justice Secretary Alberto Agra affirmed the ruling of his predecessor, Agnes Devanadera, who junked the reckless imprudence resulting in homicide charge filed against Gutierrez. 

Gutierrez was charged in connection with the death of the actor’s personal assistant, Nomar Pardo, in last year’s road mishap.

Agra junked the motion for reconsideration lodged by Nomar’s widow, Lorayne. The DoJ chief said he already signed the resolution last week after finding no reason to reverse Devanadera’s decision.

Lorayne charged Gutierrez with reckless imprudence resulting in homicide in connection with the May 22, 2009 vehicular accident in Cavite that killed Nomar.

She blamed Gutierrez’s alleged utter disregard of traffic rules for the death of her husband.

Gutierrez was driving his Nissan Skyline GTX when it crashed into a pole along a blind curve in Silang, Cavite. In a previous interview, Gutierrez reiterated that what happened in Cavite was an accident. -ABS-CBNnews
